These terms are an agreement between you and Robert Shaw, doing business as Built to Last, covering your use of the Built to Last application and its content. By creating an account or using the app, you accept them.
1. Eligibility
You must be at least 18 years old to create an account or use Built to Last.
2. Your account
Keep your sign-in credentials private and give accurate information when you register. You are responsible for what happens under your account. Tell us at builttolasthealth@gmail.com if you believe it has been used without your permission.
3. Permitted use
Built to Last is for your own personal, non-commercial use. You may not resell or redistribute access, scrape or bulk-extract content, attempt to reach another user's data, interfere with or overload the service, probe or bypass its security, or use it to break the law or harm someone.
4. Content and ownership
The app, its design, its written material, and the Built to Last name and marks belong to us or our licensors. You get a personal, non-transferable, revocable license to use them inside the app.
You keep ownership of what you enter — your logs, measurements, and notes. You grant us only the limited license needed to store, process, and display that content so the app can work for you, including sending the specific data described in the Privacy Policy to the AI providers when you choose to use an AI feature.
5. Feedback
When you send feedback through the app, you grant us a limited, non-exclusive, royalty-free license to use it to operate, maintain, and improve the service. This does not transfer ownership of your other content, and it does not permit us to publish feedback that personally identifies you.
6. AI features and estimates
Meal Scan and Operational Debrief produce estimates and general educational guidance generated by an AI model. They can be wrong. Review and correct nutrition estimates before relying on them, and do not treat any AI output, calculation, or trend summary in this app as medical, nutritional, or other professional advice. 7. Availability and changes
We may change, add, or remove features, and the service may be unavailable at times. We do not promise uninterrupted availability.
8. Suspension and termination
You may stop using the app at any time and may ask us to delete your account. We may suspend or end access if these terms are breached or if we need to for legal or security reasons.
9. Disclaimers
The app is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent the law allows — including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app or its outputs are accurate, complete, or suited to your circumstances.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. Our total liability for any claim relating to the app is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow these limits, in which case they apply only as far as the law allows. Nothing here limits liability that cannot lawfully be limited.
11. Your responsibility to us
If your misuse of the app or your breach of these terms causes a third-party claim against us, you agree to cover the reasonable costs and damages that directly result. This applies only to the extent the claim is caused by your own conduct.
12. Governing law and venue
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Indiana, and both of us consent to that venue.
13. General
If any provision is unenforceable, the rest stays in effect. These terms, the Privacy Policy, and the Medical & Training Disclaimer are the entire agreement between us about the app. We may update these terms; the revised version will be posted with a new effective date, and we may ask you to accept it before continuing to use the app.
